My son who is now 5 tried to commit suicide and was admitted to the hospital for 8 days. This was in relation to what his father had done to him and the level of trauma that he has received.
The case is put at legal halt and trial is cancelled.
This was the absolute worst 8 days of a mothers life.
Help Save Innocence
In July of 2009 my son and daughter were physically abused by their father during an unsupervised visit. He kicked my daughter in the stomach to the point of knocking the wind out of her and my son in his legs. There have been disclosures of sexual abuse, as well. Due to the battle of this court case, I am asking for help with donations in order to continue protecting my babies while still being able to provide them with basic needs. Trial cancelled
We were scheduled to go to trial in June of 2010 to finish the custody case, but that was cancelled due to the sexual assualt situation and the counselor advising the GAL that the kids are no where near ready to have supervised visits with their father - they are still too traumatized.
Trial got reset for the end of September. The case kind of simmers down a bit.

Sexual Abuse
At the end of March 2010 both children disclosed some gruling details about being touched in appropriately by their father.
My son made a statement: "I was in the bath tub with daddy; when I went under water and came back up he asked me to sit on his face and I said no. He then put me on his face and started blowing bubbles on my pee pee."
I immediately took the children to the hospital to be looked at an interviewed. They refereed us to a sexual assault center for further interviewing.
During the investigation the police also got involved and one of the detectives attended the interview where the children were recorded on DVD. They would not tell me what was said until the case was closed.
They closed the case just a few weeks later. I began ordering police reports and records of this situation.
In reports it stated that both children said they had been touched by their father on their private parts. This was stated to the hospital case workers and the the sexual assault center during their recorded DVD interview.
I was in complete shock - but once again, NOTHING absolutely NOTHING was done about it. I had to fight even harder this time. Lord only knows when he did this to my babies. They were only 3 and 5 when the assault accord, but he left a scaring impression on both of them to have remembered this 9 months after the assault. Again I am beside myself.....

Second Court Date
We find ourselves back in court. At this time the children have a new counselor and she had been recommended to us by the GAL.
In the January order it stated that the GAL and the counselor have to agree on when dad starts visitation with his children. Since we didn't have a new counselor at this time, that didn't apply so the GAL had to put his own recommendations in and that was adopted by the court.
A new order was put in to affect similar to the January order - this time stating that the children must engage in at least one counseling session before being able to see the children on Saturday and Sunday from 10 am to 6 pm and one weekly hamburger date. It also stated that the children's counselor and the GAL have to agree on when visitation begins....
A new counselor was assigned and the Children resumed their weekly counseling sessions.

Dad was invited in to a counseling session with the children and he agreed to do so. The counselor prepared the both kids the best that she could and decided to follow-through despite the children's extreme fear and negative response to having to see him again.
The counselor told the children that we would arrive early, sit in the waiting room and then their dad would be invited in. They would be able to see him walk in and go to the counselors office. He would then stay in there and the counselor would come out and ask the kids if they wanted to see him. They were OK with this plan.
The day finally comes....we arrive early like we were asked to do. To no prevail, the counselor had him arrive even earlier, better yet - with a bag of presents!
We sat in the waiting room and the counselor came out to see if the kids wanted to go have a visit with their father. What was said to the kids "Your daddy is hear and he has some presents for you, do you want to go have a visit with him?" EXCUSE ME? That's what went through my mind at the time. It was completely unprofessional and what 4 and 6 year old would turn down presents? My children were completely manipulated.
At the end of their visit - They FLIPPED out right in the counselors office. I felt so helpless and they lost all trust in me and the counselor. The fear was right there at the for front.

First Court Date re: Custody
We went to court for our first hearing in regard to father seeking some sort of parentage rights and visitation. At this hearing the commissioner awarded me to be the primary custodial parent, father to pay child support and the kids ordered in to counseling. Dad was not to start any sort of supervised visits with the children until he engaged in a minimum of 1 counseling session with them.
The father and I were both ordered to complete the for Kids Sake seminar and an 8 week parenting class - apparently it's Typical in WA courts when it comes to divorce or custody cases. Our next hearing was scheduled for 04/15/2010 and a GAL (Guardian Ad Litem - works in the best interest of the children).

On July 4, 2009 the police and paramedics were called to my home to check out both children. My daughter was crying because her stomach hurt.
When the paramedics arrived, they checked both children and asked what had happened. The children were separated while being checked out and questioned. They both stated the same exact thing.
The police arrived shortly after the Paramedics and took photos of my daughters stomach and my sons legs in the area that he had been kicked. There was no visible bruising on my daughters stomach, but my son did have a bruise on his leg.
The case was assigned to a detective who then interviewed the father. Again, he admitted to the assault on my daughter but did not admit to the assault on my son. The case was then forward to the prosecutor for charges.
In September 2009 I received a phone call that even though CPS founded the case and he admitted to fault, they were not going to press charges since my daughter would have to take stand in court at now 6 years old and it would be to detrimental for her. It made no sense to me.
